In a critical turn of events, a New Mexico District Court has dismissed the voluntary manslaughter charges against Alec Baldwin concerning the 2021 fatal shooting on the "Rust" movie set.
A court ruling emphasized prosecutorial misconduct as the reason for dismissing the actor's charges, marking a definitive moment in the ongoing legal saga, Deadline reported.
The dismissal by Judge Mary Marlowe Sommer occurred on July 12, squarely at the onset of Baldwin's trial. It addressed the tragedy that unfolded on October 21, 2021, when cinematographer Halyna Hutchins was fatally shot, and director Joel Souza wounded during a film rehearsal on the "Rust" set.
Special prosecutors Erlinda Johnson and Kari Morrisey were at the helm of Baldwin's case. Following the incident, Baldwin, the film's co-producer and actor, was rehearsing a scene involving a gun, declared safe by assistant director David Halls, who later confessed to neglecting a proper check on the weapon.
The indictments against Baldwin originated from former District Attorney Mary Carmack-Altwies in January 2023. By the spring of the same year, Baldwin's initial charges were dismissed, only for a new grand jury to re-indict him on January 19, 2024.
Throughout the trial's beginning phases, discovery violations and testimonial inaccuracies led Judge Sommer to conclude that only a dismissal could rectify the trial's tainted process. "Dismissal was her only option because anything else would not cure the fundamental unfairness that the State's misconduct, and its reverberations in the trial, had infused into the proceeding," dictated Judge Sommer's decisive ruling.
David Halls, the assistant director, admitted his role in the oversight: "Halls later testified he had not checked it properly after taking it off Gutierrez-Reed, who was outside the location."
